Terms and Conditions for any trips arranged by or sold by Apex Ocean Travel:
Booking Confirmation and Payment: By confirming a booking with Apex Ocean Travel, you agree to abide by and accept these terms and conditions. All bookings are subject to availability and confirmation. A deposit, as specified at the time of booking, is required to secure your reservation. The booking is not confirmed until the customer receives a confirmation of payment email. Full payment must be received by the specified due date, before the commencement of the trip. Please read the full terms and conditions below carefully before booking.
Payment Methods: Payment for trips can be made using the following methods: Zelle, wire transfers, credit cards, PayPal, Wise, and personal checks. Please note that wire transfer fees, if any, are the sole responsibility of the sender. Credit card payments may be subject to additional processing fees, as determined by the respective credit card issuer or payment processor. Payment details will be provided upon booking confirmation. All payments must be made in the currency specified by Apex Ocean Travel and must be received by the specified due date to secure your reservation. Failure to make timely payments may result in the cancellation of your booking, subject to the cancellation policy outlined in these terms and conditions.
Deposit, Cancellation, and Refund Policy: Deposits must be submitted to Apex Ocean Travel to confirm a reservation. Deposits are non-refundable. Deposit amount will be stated on the customer invoice. Trips booked within 70 days of departure require full payment to confirm the booking.
Cancellations must be made in writing and are subject to the following cancellation fees in addition to any fees levied by the operators, or any third party service provider for the trip: Cancellation over 120 days prior to departure: deposit per participant is forfeited plus any fees levied by third party service providers of the trip.
Cancellation within 120-60 days prior to departure: 50% cancellation charge of the trip cost applies plus any fees levied by third party service providers of the trip.
Cancellation made within 60 days of departure: 100% cancellation charge of trip cost applies.
Liability Waiver: By participating in trips organized by or sold by Apex Ocean Travel, you acknowledge and accept the inherent risks associated with traveling, diving, and diving related activities including but not limited to snorkeling, boating, freediving, swimming etc. Participants are required to sign a liability waiver prior to the commencement of any trip, releasing Apex Ocean Travel and its affiliates, including trip leaders, from any liability for personal injury, loss, death, or damage to property.
Health and Insurance Requirements: It is the customer’s responsibility to disclose any pre-existing medical conditions or disabilities that may affect their ability to safely participate in diving or diving related activities. Apex Ocean Travel reserves the right to refuse participation to individuals who are deemed unfit for diving or diving related activities. All customers must obtain and show proof of dive insurance before their trip commences.
Itinerary/Price Changes: Apex Ocean Travel is not liable for any modification made by the service provider of the itinerary, dive sites, or accommodations due to factors such as weather conditions, unforeseen circumstances, or safety considerations. Every effort will be made to provide suitable alternatives, but no refunds will be issued for itinerary changes beyond the control of Apex Ocean Travel. Apex Ocean Travel is not liable for any marine park fee or fuel charge price changes made by any third party supplier of services for any trip. Prices displayed on the Apex Ocean Travel website are in USD. These may vary slightly based on currency exchange rates, and the customer is fully responsible for any increase in trip price due to changes in currency exchange rates.
Limitation of Liability for Inaccuracies: Apex Ocean Travel is not liable for any inaccuracies, errors, or omissions in the content presented on its website, social media channels, documentation, forms, or any other promotional materials. While we endeavor to provide accurate and reliable information, we cannot guarantee the completeness or reliability of the content provided. Customers are responsible for verifying the information provided and should not rely solely on the content displayed for making travel decisions. Any information or advice provided by us on matters such as permits, visas, vaccinations, climate, clothing, baggage, special equipment, etc. is given in good faith but without responsibility on our part. Any reliance on the information provided is at the participant’s own risk. Apex Ocean Travel reserves the right to make changes or updates to its website, social media channels, documentation, forms, or other promotional materials at any time without prior notice.
Force Majeure Events: Apex Ocean Travel shall not be liable for any delays, cancellations, or modifications to travel plans resulting from natural disasters, social uprisings, civil disturbances, government actions, wars, terrorist activities, or any other events beyond our reasonable control (collectively referred to as “Force Majeure Events”). In the event of a Force Majeure Event, Apex Ocean Travel reserves the right to modify, postpone, or cancel dive trips without prior notice. Participants acknowledge and accept that Apex Ocean Travel is not liable for any losses, expenses, or damages incurred as a result of Force Majeure Events, including but not limited to transportation costs, accommodation fees, or any other incidental expenses. Participants are encouraged to obtain comprehensive travel insurance to mitigate the financial risks associated with such events.
Travel Insurance Recommendation: Apex Ocean Travel highly recommends that all participants purchase comprehensive travel insurance. Travel insurance should include coverage for medical emergencies, trip cancellations or interruptions, baggage loss or damage, and other unforeseen circumstances. Participants acknowledge that diving and travel carry inherent risks, and travel insurance can provide valuable protection against financial losses or expenses incurred due to trip disruptions, medical emergencies, or other unforeseen events. Apex Ocean Travel is not liable for any expenses, losses, or damages incurred by participants who fail to obtain adequate travel insurance or dive insurance coverage.
Code of Conduct: Participants are expected to adhere to all safety guidelines, environmental regulations, and codes of conduct established by Apex Ocean Travel, dive operators, and local authorities. Any behavior deemed reckless, disrespectful, or harmful to marine life or the environment may result in immediate expulsion from the trip without refund.
Travel Documents and Vaccines: Participants are responsible for ensuring that they possess valid passports, visas, and any other required travel documents for entry into their destination country. Participants are also responsible for ensuring they possess any required vaccinations for entry into their destination country. Apex Ocean Travel will not be held liable for any delays, expenses, or disruptions resulting from inadequate or expired travel documents, or lack of vaccines.
Trip Leader Assignment: Apex Ocean Travel reserves the right to assign or change trip leaders at any time before or during the dive trip without prior notice. Trip leaders may be substituted due to unforeseen circumstances, scheduling conflicts, or for any other reason deemed necessary by Apex Ocean Travel. Participants acknowledge and accept that the qualifications, experience, and leadership style of the trip leader may vary, and agree to cooperate with and follow the instructions of any assigned trip leader for the duration of the trip. Apex Ocean Travel will make reasonable efforts to ensure that all replacement trip leaders are suitably qualified and capable of leading the trip effectively.
Room Assignments for Solo Travelers: Apex Ocean Travel endeavors to accommodate solo travelers to the best of its ability; however, we do not guarantee same-sex room assignments for solo travelers or odd number groups. Room assignments are subject to availability and may involve sharing accommodations with travelers of the opposite sex or other arrangements as necessary. Participants acknowledge and accept this possibility when booking travel with Apex Ocean Travel.
Complaints and Disputes: In the event of any complaints or disputes arising during the dive trip, participants should notify Apex Ocean Travel or a trip leader immediately, who will attempt to resolve the issue promptly and fairly. Apex Ocean Travel is not liable for any unresolved disputes.
Acceptance of Risk: Scuba diving, snorkeling, freediving, swimming, and diving related activities involve inherent risks, including but not limited to decompression sickness, barotrauma, marine animal encounters, dangerous currents, and equipment malfunctions. Participants acknowledge and accept these risks and agree to exercise caution and follow all instructions provided by dive professionals and trip leaders. Apex Ocean Travel is not liable for any injuries or equipment malfunctions that occur during the trip. Any air or surface journeys will be subject to the conditions applied by the carriers for the journeys in question.
